Low Carbon Contracts Company (LCCC) is delighted to announce that a further three Contracts for Difference (CFD) projects have passed their first milestone. This follows our earlier announcement on 15 October that 95% of Allocation Round 2 capacity had passed the Milestone Requirement. Read the full announcement here.
ESC has today published its Annual Performance Report for 2018, which can be found here. As the appointed Settlement Body for the Capacity Market, the Electricity Settlements Company (“ESC”) must, in accordance with regulations, produce an annual report on the performance of its functions in respect of each capacity year. The annual report covers the period 1 October 2017 to 30 September 2018.
On behalf of the Electricity Settlements Company, EMRS has today issued circular 173 to make Suppliers aware that following publication of a consultation on 19 December 2018 by BEIS (consultation on Technical Changes to the Capacity Market), a Modification ‘P378’ to the Balancing and Settlement Code (BSC) was raised on 20 December 2018. Full details and next steps can be found on the P378 page and the associated documentation on that page.
In light of the consultation published by BEIS today on Technical Amendments to the Capacity Market, ESC is willing to continue to hold suppliers’ paid October and November CM Supplier Charges, pending the outcome of the consultation, which envisages potential for ESC to continue to collect the charges during the standstill period. However, if a supplier wishes to receive a refund in the meantime, bearing in mind that BEIS is consulting on whether collections can and should resume in the New Year, we have published a process for this set out in EMR Circular 171.

ESC has today received a letter from BEIS requesting that capacity payments are suspended with immediate effect, following the decision by the General Court of the Court of Justice of the European Union annulling the European Commission’s state aid approval of the Capacity Market. From today ESC has therefore suspended all capacity payments and collection of the Capacity Market Supplier Charge that funds them from electricity suppliers. We will be returning to electricity suppliers their share of any funds for 2018/19 capacity payments that we are currently holding. We have also commenced a process to return to electricity suppliers (who fund the scheme) and capacity providers (who benefit from the scheme), any credit cover we are holding in respect of payments that have now been suspended.
