LCCC and ESC have issued today a new Bulletin which covers: new Initial Conditions Precedent (ICP) Guidance, an update to Installed Capacity (IC) and Final Installed Capacity (FIC) Guidance and a Capacity Market update.
In advance of the results of AR3, LCCC has published the Initial Conditions Precedent (ICP) Guidance to assist new Generators in fulfiling the first requirements under their Contract for Difference (CfD). Failure to fulfil these requirements may give rise to termination. Following the fulfilment of these requirements certain provisions of the CfD become effective. The guidance includes the Know Your Customer form and the Legal Opinion template, which are also available as individual downloads.
LCCC has updated the Installed Capacity and Final Installed Capacity Guidance to improve clarity on the topic and on the relevant provisions under the Contract for Difference terms and conditions. Version 3 supersedes previous ones.
